Terms of Service
MUSCLE Flex is operated by Adhibita, St. Louis, Missouri, USA ("Adhibita", "we", "us"). Contact: [email protected]. MUSCLE Flex is in beta. We will notify you of material changes by email before they take effect.
1. Acceptance.
These Terms govern your access to and use of MUSCLE Flex: the adhibita.com website, the Flex API, the account portal at app.adhibita.com, and related documentation and tooling (collectively, the "Service"). By creating an account or using the Service you agree to these Terms and to the Acceptable Use Policy (adhibita.com/aup) and Privacy Policy (adhibita.com/privacy), which are incorporated by reference. If you use the Service on behalf of an organization, you represent that you are authorized to bind it.
2. Eligibility and accounts.
You must be at least 18 years old and not barred from the Service under applicable law or sanctions programs. Access is currently invite-only. You are responsible for your account credentials and API keys, for all activity under your account, and for keeping your registration information accurate.
3. Beta status.
The Service is provided as a beta. Features, pricing, quotas, and availability may change, be suspended, or be discontinued at any time. Service levels are not guaranteed during the beta period. We may revoke beta access at any time.
4. Fees; prepaid credits.
The Service is paid for with prepaid credits. Usage is metered per request and deducted from your credit balance. During the beta there is no online checkout: credits are added to your balance by our team at your request. How failed requests are charged, and what happens when your balance runs out, is set out below. You do not need accounts with, or credentials for, any third-party AI model provider: we route requests on our own accounts and are responsible for those relationships. Current pricing is provisional and may change with notice through the Service or by email. If online checkout is enabled later, payments will be handled by a third-party payment processor.
Failed requests and negative balances. A request can fail after the underlying model has already done work. We are charged for that work whether or not the request succeeds, so we charge you for it at the same rate as a successful request. This includes work done before a request fails, a request you cancel or disconnect from, and a request that ends with an empty reply or a reply cut off by a limit you set (for example a max_tokens value you chose).
Failures that are ours are free. We do not charge you when a request fails because of a limit we set or a fault on our side. Specifically, we waive the charge when the request ends because it reached our own time limit, because a multi-step answer timed out or returned an unusable result, or because the reply was cut off by our default output limit (when you did not set your own). We also never charge you for a failure caused by a bug in the Service.
Fair-use allowance. So that free failures cannot be used to obtain free usage, charges waived for failures at our limits are subject to a fair-use allowance for each account, which we may set and adjust. Above the allowance, a failure at one of our limits is charged like any other request that used model work. We record each waiver and whether it counted against your allowance. Failures caused by a bug in the Service do not count against it.
Safety screening. If safety screening is enabled on your account in enforcing mode, each screened request costs $0.0000135, including a request the screen refuses. Screening in monitor-only mode is not charged.
Negative balances. If a charge is larger than your remaining credits, for example a charge for work that is reported after a request finished, your balance can go below zero. While your balance is zero or negative, paid requests are declined with an insufficient-credit error until you add credits that cover the amount owed. We do not suspend your account for this reason and we do not charge a payment method automatically.
Refunds. A refund covers only credit you have not used. If a refund, chargeback or other payment reversal removes more credit than your current balance, the difference is recorded as a negative balance and your account may be suspended until it is resolved with our team. We do not charge a payment method automatically to recover it. Taxes, credit expiry, how a payment can be refunded and the merchant of record will be stated before you add credits.
5. Acceptable use.
You must comply with the Acceptable Use Policy at adhibita.com/aup. We may suspend or terminate access for violations.
6. Content; AI outputs.
You retain ownership of content you submit ("Inputs"). You are responsible for Inputs, for how you use outputs ("Outputs"), and for reviewing Outputs before relying on them. AI Outputs may be inaccurate or incomplete and do not constitute professional (legal, medical, financial, or other) advice. You grant us the limited rights needed to operate the Service: routing, metering, securing your requests, and, where response caching is enabled for your account, temporary caching. We do not use your Inputs or Outputs to train models. Our usage and routing records are designed to hold categorical information rather than the text of your Inputs or Outputs, with one exception: when a request goes through an automated code-verification step that fails, the routing record can keep the generated code and the verification report so we can diagnose routing quality. We do not control how third-party model providers handle content they receive (see section 7) and do not promise that they retain nothing.
7. Third-party services.
The Service routes requests to third-party AI model providers that we contract with. Their processing of prompt and completion content is governed by our agreements with them and their own terms and privacy policies. The Service also relies on hosting and email delivery infrastructure described in the Privacy Policy.
8. Privacy.
Our handling of personal information is described in the Privacy Policy at adhibita.com/privacy.
9. Suspension and termination.
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, legal risk, or ending the beta, with notice where practicable. A negative balance from usage is not on its own a ground for suspension; a shortfall left by a refund or payment reversal can be (see section 4). On termination, we will make reasonable efforts to allow export or deletion of account data upon request.
10. Disclaimers.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.
11. Limitation of liability.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD 100. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification.
You will indemnify and hold us harmless from claims, damages, and expenses arising from your Inputs, your use of the Service in violation of these Terms or law, or your violation of third-party rights.
13. Governing law and venue.
These Terms are governed by the laws of the State of Missouri, USA, without regard to conflict-of-laws rules. Subject to applicable law, the exclusive venue is the state or federal courts located in St. Louis, Missouri, and you consent to their jurisdiction.
14. Changes.
We may update these Terms. Material changes will be notified by email, or through the Service, at least 7 days before they take effect (or immediately where required by law). Continued use after the effective date constitutes acceptance. The "Last updated" date above shows the current version.
